Conditions Applicable

The agreement between Condell Ltd and the purchaser shall incorporate these conditions, which shall govern the agreement to the exclusion of any other terms and conditions.
On occasion we may produce or supply documents that contain errors or omissions. We always take care to avoid such errors or omissions. However, should such an error or omission occur, then the purchaser shall not be entitled to rely on that error or omission which shall be corrected by Condell Ltd without any liability on the part of Condell Ltd.
If any provision of these conditions is adjudged invalid or unenforceable in whole or in part the validity of the other provisions of these conditions and the remainder of those provisions in question shall not be affected.
Nothing in these conditions shall affect the purchaser's statutory rights as a consumer.
Nothing in these conditions shall limit Condell Ltd's liability for:
  • Fraudulent, malicious or criminal acts.
  • Personal injury or death caused by the Seller's negligence.
  • Any other liability that cannot be excluded by law.

Subject to the conditions listed above, no statement, description, warranty, condition or recommendation contained in any catalogue, price list or advertisement or communication or made verbally by any of the agents or employees of Condell Ltd shall be construed to enlarge, vary or override any of these conditions.

Making A Purchase

Making a purchase could not be easier. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept MasterCard, Debit MasterCard, Visa Credit, Visa Debit, Visa Electron, Maestro, JCB and Solo cards. Payment for orders placed on the Condell Ltd website are taken and processed immediately via FreedomPay. For orders placed over the phone credit card details are taken and processed immediately in our office.

By completing and submitting the electronic order form (or proceeding through the 'checkout process') you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Neither completing the checkout process nor receiving confirmation of an order constitutes our acceptance of your order. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

Back Orders

If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait.

Regional Variation

As some products are subject to regional availability we may contact you to advise of this and offer an alternative product, This in some cases may incur an extra charge.
Unfortunately on some occasions certain products may not be available for supply from ourselves or through our third party suppliers, in this case you will be advised and a credit may have to be raised.

Delivery

Delivery Schedule

  • A preferred delivery date can be entered when ordering the goods. These will be adhered to wherever possible.
  • The delivery date will be confirmed with the confirmation that the order has been placed.
  • Please do not arrange to have a tradesman on site until after your goods have arrived and you have checked them (we will not pay your tradesman's costs in the event that the goods have arrived late, been damaged in transit or are not suitable for any reason).
  • Any delivery dates or periods quoted by the Company are estimates only, given in good faith and the Company shall not be liable for any loss or damages whether direct or consequential resulting from any failure to meet such delivery dates or periods. All goods shall be delivered to the Purchaser's premises in the United Kingdom and risk in the goods shall pass on such delivery. Goods offered from stock are offered subject to their still being available when the Purchaser's order is received.

Next Working Day Delivery

  • The order must be placed before 12 noon on the working day preceeding the delivery date otherwise the order will be processed the following working day.
  • Only those products marked as eligible for the next working day service will be delivered via the next working day service. Any other products on the order will be delivered via our standard delivery service.
  • If a product delivered by the next working day delivery service is returned there will be no refund of the next working day delivery charge.

Delivery Charges

Collection
  • Collection is free for any size order from the Horsham or Kings Langley branches.
Standard Delivery Charge
  • Orders with a sales value of over £500 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £500 or less (excluding VAT) will be charged a delivery cost of £44.99 (excluding VAT).
Small Item Delivery Charge
  • Small items (marked as such as on the website) shall be subject to a delivery cost of £5 on all sales of £50 or less (excluding VAT).
  • Those orders of such items over £50 (excluding VAT) shall be delivered free of additional charge.
Bricks Delivery Charge
  • All orders will be charged a delivery cost of £75.00 (excluding VAT).
Expamet Delivery Charge
  • Orders with a sales value of over £850 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £850 or less (excluding VAT) will be charged a delivery cost of £45 (excluding VAT).
Standard Concrete Lintels Delivery Charge
  • Shipping costs will be calculated based on your location and item dimensions. The exact shipping charges will be displayed on the checkout page before you complete your purchase. This ensures accurate and fair pricing tailored to your specific order.
Fire Rated Concrete Lintels Delivery Charge
  • All orders will be charged a delivery cost of £95.00 (excluding VAT).
Steel Lintels Delivery Charge
  • Shipping costs will be calculated based on your location and item dimensions. The exact shipping charges will be displayed on the checkout page before you complete your purchase. This ensures accurate and fair pricing tailored to your specific order.
Insulation and Dry Lining Delivery Charge
  • Insulation and Dry Lining products are subject to a delivery cost of £44.99 (excluding VAT) on all orders under £400.
  • Those orders of such items over £400 (excluding VAT) shall be delivered free of additional charge.
Lead Delivery Charge
  • Orders with a sales value of over £3000 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £3000 or less (excluding VAT) will be charged a delivery cost of £75.00 (excluding VAT).
Plumbing & Drainage Delivery Charge
  • All orders will be charged a delivery cost of £35 (excluding VAT).
QIC Trims Delivery Charge
  • All orders will be charged a delivery cost of £30 (excluding VAT).
Sheet Materials Delivery Charge
  • Orders with a sales value of over £1000 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £1000 or less (excluding VAT) will be charged a delivery cost of £85.00 (excluding VAT).
Timber Delivery Charge
  • Orders with a sales value of over £300 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £300 or less (excluding VAT) will be charged a delivery cost of £30.00 (excluding VAT).
Tools and Ironmongery Delivery Charge
  • Products from our tools and ironmongery ranges are subject to a seperate delivery cost of £12.50 on all sales of £100 or less (excluding VAT).
  • Those orders of such items over £100 (excluding VAT) shall be delivered free of additional charge.
Velux Standard Delivery Charge
  • Orders with a sales value of over £350 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £350 or less (excluding VAT) will be charged a delivery cost of £45.00 (excluding VAT).
Velux Blinds Delivery Charge
  • Orders with a sales value of over £400 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £400 or less (excluding VAT) will be charged a delivery cost of £15.00 (excluding VAT).
YBS Delivery Charge
  • Orders with a sales value of over £400 (excluding VAT) will be delivered free of additional charge.
  • Orders with a sales value of £400 or less (excluding VAT) will be charged a delivery cost of £44.99 (excluding VAT).

Standard Terms of Delivery

  • The purchaser must inform us of any shortages within 48 hours of delivery, proof of this must be written on the paperwork at time of delivery.
  • Collected orders will be free of additional charge.
  • All orders must be signed for on delivery.
  • If you keep our delivery vehicle waiting for an unreasonable time or if we are obliged to return without effecting delivery a reasonable additional charge may be made that reflects the additional cost to us.
  • If you refuse or fail to take delivery of goods tendered in accordance with your order or we are unable to deliver the goods because you have not provided appropriate instructions you shall pay us any additional costs or carriage incurred by us.
  • If delivery is deferred then you may incur charges for storage.
  • Where goods are returned a restocking fee of 25% of the sales value will be payable. Please note that carriage will not be refunded.
  • No made to measure products will be refunded.
  • The purchaser must ensure that there is reasonable access to the delivery site. If this is not available an additional charge may be made.

If you do make an order via the website to one of these areas, please be aware that there may be an additional charge or delay in delivery. You will of course be contacted in advance by a member of our sales team to inform you of this. In rare cases, because of not having any stock in a distribution depot near you, or for other reasons, it may not be possible to fulfil your order, in which case you will receive a full, no questions asked refund. We must stress, however, that Condell Ltd are committed to full customer satisfaction and will always do our best to complete your order.

Kerbside Delivery

Kerbside delivery is standard on your order. As a customer this means your goods are not delivered to the doorstep, but onto the kerbside. The goods will be delivered to the point closest to the front door that is accessible by the vehicle carrying the goods.

Inside Delivery

Condell Ltd does not recommend that you request our drivers to drop your goods beyond the kerb of the property or to carry the goods onto the property. If you do ask the driver to come off the public highway onto the property with the vehicle, the goods, or both, this is entirely at your own risk and if the driver / vehicle damages anything (eg manhole covers / tarmac driveways / block paved drives / flagged driveways / gravelled and stoned driveways / public footpaths / grassed areas / walls / pillars / gate posts / gates / trees / hedges / telephone wires / lights etc) the cost of repair will be your responsibility, not that of Condell Ltd.
Therefore, if you ask our drivers to come onto the property, the property owner will be required to sign and date a disclaimer absolving Condell Ltd of all responsibility for any damage beyond the kerbline.

Direct Orders and Site Deliveries

The Company will despatch goods direct to a third party or site at the Purchaser's request. Goods sent to a third party or to a site are despatched at the Purchaser's risk.

Special Routing

Goods will be sent by any special route or carriers at the Purchaser's request. All goods so despatched are sent at the Purchaser's risk and any carriage and expenses incurred will be charged to the Purchaser.

Carriage

Carriage and haulage will be agreed and charged as appropriate.

Risk

The risk in the goods shall pass to the Purchaser on delivery.


Returns & Refunds

Consumer Returns Policy

A “consumer” means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession.
Consumers' rights to return goods are protected under the Consumer Contracts Directive which can be found at http://www.legislation.gov.uk/uksi/2013/3134/contents/made.
This states that consumers have the right to withdraw from the purchase of an item within 14 calendar days of the day that the item is delivered.
Where you are withdrawing from your purchase within the 14 calendar day cooling-off period, and there has been no error on our part, we will refund the cost of the item and the cost of sending the item to you as follows:
  • where you are returning an item that was part of a larger order, we'll refund the per-item charge for delivery that you incurred
  • where you are returning an entire order, we'll refund applicable per-item delivery charges and the per-delivery charge that you incurred
  • where we collect an item from you, we reserve the right to recover the costs of collection from you.

Where goods are returned by a consumer and we have been informed of the wish to return more than 14 days after delivery or the goods are returned more than 14 calendar days after we were informed of the wish to return the goods, we reserve the right to charge a restocking fee of 25% of the sales value. Please note that carriage will not be refunded.

Items returned because they are damaged, defective or incorrect

If you are returning an item because of an error on our part or, in accordance with our returns policy, because it is damaged or defective, you must inform us within 2 working days of delivery. We will refund the delivery charges incurred in sending the item to you and pay your costs of returning it to us.
Condell Ltd or our agent will check all items returned as damaged or defective. In the event we find no fault, we reserve the right to re-charge you for the item/s and to recover our fees and expenses from you.

Special Order and Made-to-Measure Products

Special order and made-to-measure products may NOT be returned unless they are deemed to be faulty or have been damaged in transit. (Please see details above concerning the return of faulty or damaged products).
If a product is made to measure there is a 24hour-cancellation period only, after which the product(s) you have ordered will be in the process of being manufactured to your precise measurements and therefore are not re-saleable. If you wish to cancel after this time there may be a re-stocking charge. There is no cancellation permitted once you are in receipt of your order.

VELUX Products

Any returns of VELUX products are subject to a 25% re-stocking charge unless they are damaged or faulty, or have been sent in error. The boxes are security sealed and should not be opened unless you are 100% sure that this is the correct item for installation.

Tax Charges

For orders made from the UK or the European Union, 20% VAT is added.

Credit Card Security
